Terms and conditions of this agreement shall be as follows:

 

1. SALE PRICE** :

 

Total purchase price is $____, which includes tail and dew claw removal, at least two (2) doses

of dewormer, one (1) set of shots, a record of dates these are done, instructions on how to care

for your new puppy when you get home. A deposit** of at least $50.00 is required to for us to

reserve and hold a puppy for you.

 

2. HEALTH:

 

Breeder certifies that the puppy is Genetically in good health. Buyer/s shall have the puppy

examined by Dr. Mark Means at Alpine Pet Clinic or Dr. Michael Stigge, or one of his associates at

Koch-Stigge veterinarian clinic (addresses and phone numbers noted below*) within two (2) business

days. Country Home Kennel will offer a 100% refund of the purchase Price, or a credit applied, for a

puppy that has been found to have a serious congenital condition, NOT commonly associated with the

particular breed, if discovered and documented by a veterinarian exam(s) provided by the buyer, within

two business days from the date the puppy is acquired. All supporting licensed veterinarian documentation

including but not limited to, clinical signs, diagnosis, and lab tests results must be included with any

request for refund or credit. Country Home Kennel shall not be held responsible for any of the

veterinarian expenses incurred by any buyer including but not limited to office visits, exams, diagnosis,

lab test results, surgeries, medications, etc. The puppy record and registration documentation will be

given to buyer at the time the puppy is acquired.

 

If the health of the Puppy declines due to the fault of the buyer/s, NO refund will be given. If the buyer

fails to have the puppy checked with in the 2 business days time frame then the guarantee is null and void.

Country Home Kennel will refund only the purchase price of your puppy. If you choose to take the puppy

to another vet and something is found to be wrong , you are required to get a second opinion from one

of the vets listed above before a **refund will be given. (*Please see paper titled Care of your puppy for

information on stress and separation anxiety).

 

3. AKC REGISTRATION:

 

AKC registration papers are the responsibility of the buyer/s. The application along with the puppy

record will be handed to the buyer/s at the time of purchase.

 

4. MAINTENANCE, CARE AND LIABILITY:

 

The buyer/s agree to maintain said puppy in good health. Buyer/s will be solely responsible for any

Veterinarian fees, claims, lawsuits, fines, or any other legal action arising from said puppy’s actions

and agrees to hold Country Home Kennel completely harmless in the event of any legal action from

said puppy. The puppy is considered to be a family companion and thus a house dog that will not be

left outside in inclement weather. Buyer/s agrees that this puppy will not be chained for more than 24

continuous hours in any Seven-(7) day period or trained or used as an attack dog. The buyer/s shall

never abandon this dog to an animal shelter nor sell it to a research center. Buyer/s understand that

violation of these terms will cause physical and emotional harm to this puppy. It is to the buyer/s

discretion to spay/neuter the puppy. Breeder/s do encourage spaying/neutering for the benefit of health.

 

5. HARM TO BREEDER AND LIQUIDATED DAMAGES:

 

Buyer/s agrees to and fully understands that any violation of the provisions of this agreement could

and will cause substantial harm to Country Home Kennel’s professional standing with various dog

breeders and fancier organizations and/or harm to the dog. Buyer/s agree that all violations of the

provisions of the agreement shall result in reimbursement to Country Home Kennel of liquidated

damages not to exceed twenty five hundred dollars ($2,500.00). Buyer/s acknowledges, understands

and agreed that these liquidated damages are not a penalty, but are intended as reimbursement for

damage to the professional reputation of Country Home Kennel and/or harm to the puppy.

 

6. REVERSION OF OWNERSHIP:

 

Should the buyer/s be unable to keep the puppy as stated in this agreement for any reason or at

anytime the dog may be RETURNED to the breeder with AKC registration papers signed over, with

no monetary reimbursement at the time. All non-medical returns must be made within 2 business days.

Country Home Kennel will withhold $150.00 of your refund as a return fee for a non-medical return.

If dog is placed in a new home any money received from new owners, minus expenses to care for

the dog and the $150.00 return fee, will be forwarded to the buyer/s, up to their purchase price of

the puppy. If the dog is older than 1 year of age no refund will be given.

 

7. AGREEMENT:

 

It is understood and agreed that buyer/s by signing this form, has read and understands the

provisions of the agreement, and agrees to perform its terms beginning at the transfer of ownership.

 

8. ENFORCEMENT:

 

Buyer/s and Country Home Kennel agree that terms of this agreement shall be enforced under the

provisions of Missouri Law and Statues. Buyer/s and Country Home Kennel agree that the buyer/s

shall pay any and all legal fees, attorney fees, court costs, travel costs, and/or any other costs

associated with enforcement of the terms of this agreement.

**If a deposit is placed on a puppy the deposit will go towards the Total purchase Price and it is

non-refundable if you decide not to accept the puppy. Any refund for cash or money order

purchases will be refunded within Fourteen (14) business days.
